Memo of Opposition Congestion Pricing 2022
The MLC Steering Committee met on January 17, 2024, to discuss the NYC Congestion Pricing Tax. Specifically, the meeting was called to consider whether the MLC should seek amicus curiae status in the lawsuit commenced in the U.S. District Court for the Eastern District of New York by the United Federation of Teachers (UFT), among other plaintiffs, challenging the validity of the environmental review undertaken in connection with the Congestion Pricing program. Following a spirited and detailed discussion amongst committee members and a summary of the lawsuit by UFT President Michael Mulgrew, a vote was taken and approved to advance this discussion and formal vote to the MLC General Membership Committee. The MLC General Membership meeting and vote took place on Tuesday, January 23, 2024. The DEA is currently exploring all options, including, but not limited to, intervening in the current UFT litigation, signing onto the MLC amicus curiae brief, or initiating its own civil action in federal court. Furthermore, the DEA has already submitted a demand to bargain over the unilateral institution of the NYC Congestion Pricing Tax with the NYC Office of Labor Relations (OLR) and is currently awaiting a response from them on when these discussions will take place. As always, the DEA will keep our members apprised as we learn more about the results of the MLC vote, as well as any feedback we receive from OLR.
