The DEA will ensure that any individual who knowingly infects or attempts to infect any member with COVID-19 will be prosecuted to the fullest extent of the law — both criminally and civilly.
Please see the below Enforcement Options the Department has put out via Finest message regarding arrests of individuals who knowingly take acts likely to spread the Coronavirus such as intentionally coughing or spitting on an individual.
Be advised that the Coronavirus is listed as a contagious disease under the NYC Health Code. Specifically, any person who either intentionally or negligently exposes any member of the service to the virus through actions such as coughing or spitting on an officer can and should be arrested under Health Code section 11.31(a)(2).
