CCRB and Video Footage

CCRB has finally agreed to the following important changes which allow members of the service to view video prior to their interviews beginning. This new procedure began on Monday, July 17, 2023. Prior to the start of the interview, the Investigator will ask members of the service and their attorney if they would like to view the portions of any video that the Investigator intends to show and inquire about during the course of the interview. If the MOS elects to view such video, the CCRB Investigator will remain present and play the pre-identified portions of video to the MOS and their attorney “off the record.”  “Video” includes any video, whether from a civilian, subject Officer, witness Officer, or any other Officer, that the Investigator is going to show to the MOS during the interview, regardless of whether it is from the MOS being interviewed, another MOS, or a civilian.

“Video” may be body worn camera video or other video, such as surveillance video or mobile phone video.

If the MOS believes the CCRB possesses additional video that should be shown and discussed during the interview, the MOS may request that pertinent portions of such video be shown to the MOS and their attorney prior to the start of the interview. Upon request, the CCRB will determine whether such video is in their possession and, if it is, whether the video is relevant and material to the MOS’ interview. If the CCRB determines that the video is relevant and material to the MOS’ interview, the Investigator will show the pertinent potions of the video to the MOS and their attorney along with other video discussed. At the conclusion of the viewing, the Investigator will secure their computer and then leave the room, allowing the attorney and the MOS to confer in private, prior to the beginning of the “on the record” interview.

It is important to note that our members always have the right to view their own body worn camera footage at any time prior to the date of their interview(s). We must continue to ensure that they do, and prepare as thoroughly as possible prior to their interviews, including, but not limited to, reviewing video, You Tube, DD5s, TRIs, etc., and speak with other MOS who were present. Our Delegates are the first line of defense in that regard. There are still many more issues we must address and are addressing with CCRB.
