Update on the DEA’s Challenges to the Vaccine Mandate as of Saturday, October 30, 2021

The DEA has initiated the process of participating in a pending action, started by the Municipal Labor Committee, before the NYC Office of Collective Bargaining seeking an injunction due to the City’s failure to negotiate over all mandatory subjects of bargaining being infringed upon by the reckless and hastily implemented vaccine mandate.

Unlike the Supreme Court action filed by the PBA, in which any injunction has been rejected by the Courts, the claims raised in this matter are based on the New York City Collective Bargaining Law, and similar actions at the State-level have resulted in some success.  In furtherance of this obligation to bargain over mandatory subjects, we have also met with representatives from the City and the Department to discuss the implementation of the Vaccine Mandate. These discussions have centered around securing the best possible choices and terms for our members, anticipating that any judicial challenges to this mandate would prove to be unsuccessful, as all other legal challenges to similar mandates have likewise proven unsuccessful.

As we previously informed you, the DEA met with the NYC Commissioner of Labor Relations this week and served our list of demands regarding the terms and conditions of the impending mandate.  Last night, the City provided a proposal to us, which we soundly rejected. In short, it contained unacceptable open-ended scenarios and statutorily-deficient contingencies. We have therefore submitted a counter proposal of demands to secure the best possible benefits for our members during this chaotic situation created by the City. The topics raised during these discussions with the City, and the proposed resolutions to them, are ever-changing. Don’t believe what has been discussed on social media. The DEA has not agreed to the mandate or any of the terms of the conditions of its implementation. Realizing the Courts will not provide our members any relief, we will continue to demand the most favorable concessions possible.

As with all of the circumstances regarding the Vaccine Mandate, it is an evolving landscape, and the DEA is doing everything within its ability to fight for the rights of members who choose not to be vaccinated. All viable avenues are either being undertaken or  explored. As always, the DEA will keep you all apprised of the latest developments.
