On February 6, 2026, NYPD Sergeant Erik Duran – in a travesty of justice – was found guilty of second degree manslaughter for attempting to stop a fleeing subject who was escaping the scene of his crime on a motorcycle at 30 miles per hour on a City sidewalk populated by pedestrians, including children and Police.
Sgt. Duran made the split-second decision to protect the public by stopping the perp any way he could, and rather than use his firearm, he picked up a nearby cooler and tossed it at the perp. The perp lost control of his motorcycle and was killed when it crashed. Duran was arrested and charged with “killing” the perp.
The SBA has created an online petition to urge the court to impose a no-jail sentence as Duran faces up to 15 years in prison for trying to protect the public from a reckless miscreant.
