The City agreed to settle a federal lawsuit brought over the City’s withholding of certain pension benefits from those City workers who were called up for military service since 9/11/2001. The settlement requires the City to change the way it calculates earnings (which determines pensions). The suit could result in back pay for certain military veteran retirees and an increase in pension calculations for those military Reservists still active. The settlement has yet to be signed by the Judge assigned the lawsuit. The original class action was brought against the City by NYPD Detectives David Goodman and Michael Doherty, and Sgt. Robert Black.
